UPTONdigital Platform Privacy

UPTONdigital is owned and operated by Daniel James Upton.

This Privacy Policy explains how UPTONdigital collects, uses, shares, and protects information when you access or use the Platform.

1. Information We Collect

  • Account and business information (for example: name, email, phone, business name, address).
  • Customer Content you submit (for example: text, images, logos, service descriptions).
  • Communications with us (support requests, emails, messages).
  • Usage and device data (for example: IP address, browser/device information, pages/actions in the Platform, log data).
  • Billing data: payment status and related identifiers (for example: customer IDs, subscription IDs). Payments are processed by our payment processor.
  • Messaging data (when messaging features are used), which may include phone numbers, message content, delivery status, and opt-in/opt-out or consent records.
  • Customer Data (including leads and visitor submissions on Client Website(s)) that you collect and store via the Platform. You are responsible for notices to visitors, and we act as a service provider/processor for this data.

2. How We Use Information

  • We use information to provide and operate the Platform, create and manage accounts, host Client Website(s), and deliver features you enable.
  • We use information to process billing, prevent fraud, secure the Platform, troubleshoot issues, and improve performance.
  • We use information to communicate with you about service updates, support, and administrative messages.
  • If you enable messaging features, we use phone numbers and messaging data to send and manage messages, maintain opt-out/consent status, provide support, prevent abuse, and comply with legal and carrier requirements.
  • We may generate aggregated or de-identified analytics to understand usage and improve the Platform.

3. How We Share Information

  • We share information with Subprocessors that help us operate the Platform, such as hosting providers, analytics providers, payment processors, and messaging providers.
  • Mobile information (including phone numbers and SMS opt-in/consent data) will not be shared with third parties or affiliates for marketing or promotional purposes.
  • We may share mobile information (including phone numbers and SMS opt-in/consent data) with service providers solely to provide the Platform and messaging services (for example: sending messages, maintaining suppression/opt-out lists, delivering support, preventing fraud/abuse, and complying with law and carrier rules).
  • We may share information when required by law, to respond to legal requests, or to protect rights, safety, and security.
  • We may share information in connection with a merger, acquisition, or sale of assets, subject to appropriate confidentiality and notice where required.
  • We do not sell personal information.

4. Cookies and Tracking

  • The Platform may use cookies or similar technologies to enable login, maintain sessions, prevent abuse, and remember preferences.
  • If we use non-essential analytics or marketing tracking, we will provide notice and, where required, request consent before enabling those trackers.

5. Data Retention

  • We retain information as long as your account is active and as needed to provide the Platform.
  • We may retain certain records for legal, tax, fraud prevention, security, and operational purposes.
  • You may request deletion of your account information, subject to lawful retention obligations.

6. Security

  • We take reasonable measures to protect information, including access controls and encryption where appropriate.
  • No system is completely secure, and we cannot guarantee absolute security.

7. International Transfers

If you access the Platform from outside the country where our systems or Subprocessors operate, your information may be processed in other jurisdictions. We take steps designed to ensure appropriate safeguards where required by law.

8. Your Rights and Choices

  • You may request access to, correction of, or deletion of your personal information by contacting us.
  • You may also request information about how we process your information and the categories of data we collect.
  • We may require verification of identity before fulfilling certain requests.
  • Some jurisdictions provide additional rights (for example: opting out of certain processing). Where applicable, we will honor those rights as required by law.

9. Changes to This Policy

We may update this Privacy Policy from time to time. Changes will be posted with a new “Last updated” date. Continued use of the Platform after changes become effective constitutes acceptance.
